Terms and Conditions

1. About these Terms

These Terms and Conditions ("Terms") are a legal agreement between you and GiftKoin LTD, a company registered in England and Wales under company number 17080362, whose registered office is at 167–169 Great Portland Street, London, W1W 5PF ("GiftKoin", "we", "our", "us"). They govern your use of giftkoin.com (the "Site") and the digital gift cards we sell through it (the "Service").

By creating an account, signing in, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or the Service.

Each order you place creates a separate contract for the digital code you have ordered, on these Terms.

We may update these Terms from time to time. Section 15 explains how.

2. Eligibility

You may use GiftKoin only if:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding contract.
  • You are not located in, ordinarily resident in, or directing activity from a country, territory, or list subject to comprehensive sanctions enforced by the UK, the United Nations, the European Union, or the United States.
  • You are not a person, entity, or wallet on a sanctions, terrorism-financing, or money-laundering list maintained by any of those authorities.

We may block, refuse, or unwind orders where any of these conditions is not met.

3. Your account

One person, one account. You may hold only one GiftKoin account. Multiple accounts controlled by the same person are a breach of these Terms and may be closed under section 11.

Sign-in. You can sign in with email and a one-time code, or with Google or Apple. The Privacy Policy explains what we receive from those sign-in providers.

Your account is for you alone. Do not share your sign-in credentials, one-time codes, OAuth session, or any device or browser that is authenticated to your account, with any other person. Anyone who logs into your account is treated as you for the purposes of these Terms until you tell us your account has been compromised.

Your responsibility. Keep your sign-in details, devices, and browsers secure. Anything done through your account is treated as done by you, unless you tell us promptly that your account has been compromised.

Accurate information. Give us accurate information when you sign up and during identity verification. Tell us when your account email changes — we use it for legal and contractual notices (see section 14).

Closing your account. You can ask us to close your account at any time by emailing [email protected]. If you have positive store credit when you ask, we hold the closure for 30 days so you can spend the credit on the Site. After 30 days the account is closed and any remaining store credit is frozen and cannot be returned to you, in line with section 8.

4. What we sell

GiftKoin sells digital gift card codes issued by third-party platforms — for example Apple, PlayStation Network (Sony), Steam (Valve), Google Play, and similar. We are a reseller. We are not affiliated with, endorsed by, or sponsored by any of those platforms. Their names and marks belong to them.

When you buy a code from us, you also become subject to the rules of the platform that issued the code. Each platform decides:

  • Where the code can be redeemed (region locks).
  • Who can redeem it (account requirements, age, identity).
  • What the code can be used for and the validity period.
  • What happens if the platform freezes, invalidates, or claws back a code (for example, if it suspects fraud or a violation of its own terms).

You agree to read and follow the issuing platform's own terms before redeeming a code. If a platform takes action against a code after you have redeemed it onto your own account — including freezing it, asking for further identity verification, or removing the credit — that is a matter between you and the platform. Our contractual obligation is set out in section 7.

5. Pricing and payment

Quoted in fiat, paid in crypto. Prices on the Site are quoted in a fiat currency. When you place an order, we convert the price into the cryptocurrency and network you choose at the exchange rate we publish at order creation, and we lock the token amount for the duration of the payment window. The published rate may include a margin we apply to the underlying market rate; the rate you see at order creation is the rate that applies to your order.

Single rate per order. The exchange rate locked at order creation is the single rate that applies to your order. We use it both to calculate the token amount you must pay and, where store credit is added under section 8 (for example, on over- or underpayment), to convert that amount to USD. We do not re-rate at the moment funds arrive on-chain.

Price changes. Prices on the Site may change at any time and without prior notice. The price that applies to your order is the price displayed at the moment you click Pay now, after any discount applied under your customer tier (see section 17) at that time. Price changes after you complete payment do not entitle you to a refund or rebate; price changes before you complete payment are not a breach of these Terms.

Payment window. The exact payment window for the token and network you chose is shown at checkout. If your payment is not received and confirmed within the window, the order expires.

Network confirmations. The number of network confirmations required for the token and network you chose is shown at checkout. We treat your payment as received only after the required confirmations.

One-time payment addresses. Each order shows a unique receiving address. The address is for that order only. Do not save it. Do not reuse it for a future order. Do not send anything to it after the payment window has expired. If you send funds to an expired address, an old address from a previous order, or to an address we never gave you, we cannot guarantee that we can recover or refund those funds, and you accept that risk.

Wrong network. If you send a token on a network we did not show for that order, we cannot recover those funds and we are not liable for them.

Exact amount. The amount you send is treated as follows:

  • Exactly the quoted amount — the order is fulfilled.
  • More than the quoted amount — the order is fulfilled, and the excess is converted to USD at the order's locked rate and added to your store credit. The excess cannot be refunded.
  • Less than the quoted amount — the order is not fulfilled, and the amount you sent is converted to USD at the order's locked rate and added to your store credit. It cannot be refunded.

Store credit is described in section 8.

No bank cards. GiftKoin does not accept bank cards. Do not enter card details anywhere on the Site — we do not collect them.

6. Order lifecycle and fulfillment

When you click Pay now, you make us an offer to buy the digital code on these Terms. We accept your offer when:

  • We confirm the required network confirmations of your payment for the quoted amount.
  • The order passes our risk and sanctions checks.
  • Where required, you have completed identity verification (see section 9).

If any of these conditions is not met, we may refuse, delay, or unwind the order. If we unwind an order, the refund rules in section 8 apply.

Where the code lives. Delivered codes appear in the "My Orders" area of your account. We do not email codes themselves. We send a status email when an order changes state — for example, when the code is delivered, when the order has failed, when identity verification is needed, or when the order has been refunded — so you know to come back to your account.

You agree to check "My Orders" for the code. We are not responsible for codes that are unreadable in your account because you have blocked images or scripts.

7. Region selection and code use

You pick the region. Where a product is region-locked (for example, Apple US vs Apple UK, PSN US vs PSN EU), you choose the region when you add the product to your cart. Picking the wrong region for the account or platform you intend to redeem on is your responsibility. We do not refund or replace codes because of a wrong-region pick once the code is delivered.

No geoblock circumvention. Where we restrict the sale of a product to certain regions, we do so to comply with the issuing platform's distribution rules. Using a VPN, proxy, false location, or any other method to acquire a product that is not made available in your country is a breach of these Terms and breaches the issuing platform's terms. Codes acquired this way are at your sole risk: if the issuing platform refuses, freezes, or claws back the redemption, we will not refund or replace the code, and we may suspend your account under section 11.

You own the code from delivery. Once a code is delivered to your account, you are its sole owner. Treat it as confidential — anyone who sees the code can redeem it.

Onward sharing is at your risk. If you share a code with someone — a friend, a recipient of a gift, or a buyer if you re-sold — and they redeem it, our contractual obligation has been fulfilled. We will not refund or replace a code that has been redeemed by anyone after delivery.

Exception — proven pre-existing redemption. If a code we delivered to you was already redeemed before your purchase, we will replace it or refund it. To prove this, you must give us evidence from the issuing platform showing the redemption date is earlier than your purchase date in your GiftKoin order. The evidence can be a transaction record, a screenshot from the platform's redemption history, or a written confirmation from the platform. You must bring this claim within 30 days of code delivery. After 30 days the order is final.

Platform action after redemption. If the issuing platform freezes, invalidates, or claws back a code after you have redeemed it onto your own account, our obligation has already been fulfilled (we delivered a working unredeemed code) and we are not responsible for what happens next on that platform. Section 4 explains why.

8. Refunds, replacements, and store credit

Your store credit, in plain English. Store credit is closed-loop credit that you can use only to buy products from the Site. It is denominated in USD. It is non-refundable — we never pay it back to you in fiat, in crypto, or by any other route. It cannot be transferred to another GiftKoin account or to anyone else. It does not earn interest. It is not e-money, not a payment account, and not a deposit. It exists only as credit toward future purchases on giftkoin.com.

When funds are added to your store credit from an order (for example, on over- or underpayment), we convert them from the crypto and network they arrived on to USD at the same exchange rate we locked for that order at order creation (see section 5). That conversion is final. Where store credit is added in any other scenario covered by these Terms, we convert at the rate published on the Site at the moment the credit is added.

Refund and store credit scenarios.

We cannot deliver the code (our side). Your choice: full refund to the sender wallet in the same token, at the on-chain amount we received, or the equivalent USD added to your store credit.

You overpay. Order is fulfilled. The excess is added to your store credit in USD. The excess cannot be refunded.

You underpay. Order is not fulfilled. The amount you sent is added to your store credit in USD. It cannot be refunded.

You receive a wrong product. We replace the code or refund per the failed-delivery rule above.

You report a code that does not work because it was redeemed before you bought it. We replace or refund if you provide proof from the issuing platform that the redemption date was earlier than your purchase date (see section 7).

You change your mind after the code is delivered. No refund. By clicking Pay now you agreed to immediate digital delivery and waived your statutory 14-day cancellation right.

Our risk checks flag the transaction as high-risk and there is no court order or legal hold. We require identity verification first. After verification, we refund to the sender wallet in the same token, minus the network fee.

Identity verification is required. Section 9 applies.

Court order, regulator order, sanctions designation, or other legal hold. We hold the funds as required by law and act on the legal direction. Section 11 explains.

Token volatility. Where we refund in the same token, we refund the on-chain amount we received, not a USD-equivalent. We are not responsible for changes in the token's market price between when you sent it and when we refund.

Refunds are always in the same token. Refunds always go back in the same token, on the same network, that you paid with. We do not refund in fiat. We do not convert your refund to a different token.

Time limit on refund and replacement claims. You must bring any claim under this section — including a wrong-product claim, a code-doesn't-work claim, or a proven-pre-existing-redemption claim — within 30 days of code delivery. After 30 days the order is final and we will not consider further claims, except where UK consumer law gives you a right that cannot be limited in this way.

Investigation window. We will respond to your claim within 14 days of the date you raise it. Investigating a refund or replacement often requires us to check with the issuing platform or our supply partners. We may need information from you (for example, screenshots or platform records) to investigate; we will tell you what we need and by when.

Choosing a replacement is final. If we offer you a replacement code or store credit instead of a refund and you accept either, that decision is final. You give up the right to claim a separate refund for the same order.

Over- or underpayment + non-fault closure. Where store credit on your account arose from over- or underpayment on a single order (and not from voluntary top-up), and we close your account under section 11 for reasons that are not attributable to your breach, you may ask us to return that specific over- or underpayment as a refund. We will refund the original on-chain amount in the same token, to a wallet you nominate, minus the network fee. This applies only to the over- or underpayment portion of your store credit, not to credit that arose from any other source.

9. Identity verification (KYC)

We may ask you to complete identity verification before we accept or fulfill an order. This is short — a government-issued ID document and a brief selfie or liveness check.

When we ask. Three triggers, in any combination:

  • Cumulative activity or transaction value above thresholds we set internally and do not publish.
  • Risk screening (KYT) of your wallet address or transaction returns a flag.
  • Manual or behavioural review identifies a pattern that warrants verification — for example, unusually frequent or fragmented transactions.

We do not publish the exact thresholds. If verification is required for your order we will tell you, and we will tell you what we need.

While verification is pending. We do not deliver the code. We hold the funds in line with the UK Money Laundering Regulations 2017 and the Proceeds of Crime Act 2002, which require us not to carry out the transaction until we have verified you.

If you do not complete verification within 30 days, and there is no AML or sanctions concern. On your request after the 30 days, we will refund the funds to the sender wallet in the same token, minus the network fee. Where we cannot safely refund to the sender wallet — for example because the sender wallet is itself the source of the concern, or because it is a centralized-exchange address that cannot receive a return — we may direct the refund to an alternative wallet you nominate, or decline to refund and instead continue to hold the funds, in each case for AML or sanctions reasons.

If there is an AML, sanctions, fraud, or other legal concern. We hold the funds for as long as the law requires. We will not release them except in line with the legal direction we are under (for example a regulator's instruction, a SAR consent decision, or a court order). We are not liable for losses arising from a legally-required hold, including changes in the token's market price during the hold.

Cooperating with verification. Refusing to verify, providing false documents, or attempting to use someone else's identity is a breach of section 10 and may result in account closure under section 11.

10. Acceptable use

You agree not to:

  • Hold or use more than one GiftKoin account.
  • Share your sign-in credentials, one-time codes, or an authenticated session with anyone else, or let anyone else use your account.
  • Use a VPN, proxy, false location, or any other means to circumvent our regional restrictions or to acquire a product not made available in your country.
  • Use bots, scripts, scrapers, or any other automated means to place orders, scrape prices or stock, or interact with the Site in ways the user interface does not contemplate.
  • Reverse engineer, decompile, or attempt to extract source code from the Site.
  • Provide false or misleading information when signing up or during identity verification, including any document or image that is forged, altered, or belongs to someone else.
  • Use crypto from a wallet, address, or transaction associated with sanctions breaches, money laundering, terrorism financing, fraud, ransomware payments, darknet markets, or other illicit activity.
  • Use the Site, or attempt to use the Site, from a sanctioned territory or while subject to sanctions.
  • Engage in any conduct that is fraudulent, abusive, or designed to obtain a code without proper payment.
  • Abuse, threaten, or harass GiftKoin staff or other users on any of our communication channels.
  • Use the Service in any way that breaches applicable law in the territory where you are located.

If you do any of these, we may take any of the steps in section 11.

11. Termination

You can close your account at any time. Section 3 explains how, including the 30-day store-credit grace period.

We may close your account, suspend your access, refuse an order, or hold funds in any of the situations below. The treatment of in-flight orders and store credit depends on which one applies.

You breach these Terms (including section 10).

  • In-flight orders. We may cancel them and refund any payment received, applying the rules in section 8. Where your breach causes us actual loss, we may recover that loss under the indemnity in section 12.
  • Store credit. Frozen and cannot be returned.

Court order, regulator order, sanctions designation, SAR consent decision, or other legal hold.

  • In-flight orders. We act on the legal direction. We do not deliver, refund, or otherwise move the funds except as the legal direction requires.
  • Store credit. Held until the legal situation is resolved. We are not liable for changes in the token's market price during the hold.

We exit a market, withdraw a product, wind down the Service, or close your account for any other reason that is not your breach.

  • In-flight orders. We fulfill them or refund you, applying the rules in section 8.
  • Store credit. Frozen at closure. We give you a 30-day grace period before closure to spend the credit on the Site.

We will tell you why we are taking action where we lawfully can. Some of our reasons — for example an open regulatory investigation, a SAR, or an unresolved sanctions question — may legally prevent us from explaining in detail. In those cases we will say only what we are permitted to say.

12. Disclaimers, warranties, and liability

Service "as is". Subject to the rights you have under UK consumer law, we provide the Site and the Service "as is" and "as available". We do not warrant that the Site will be uninterrupted, error-free, or always available, that defects will be corrected, or that the Site is free of viruses or other harmful components.

Issuing platforms. We do not warrant the conduct, decisions, or availability of the third-party platforms whose codes we sell. Section 4 explains the relationship.

Statutory consumer rights are preserved. Nothing in these Terms limits or excludes:

  • Your rights under the Consumer Rights Act 2015 to digital content that is of satisfactory quality, fit for purpose, and as described — including the right to a repair, replacement, or refund where those rights are not met.
  • Liability for death or personal injury caused by negligence (Unfair Contract Terms Act 1977, section 2(1)).
  • Liability for fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under UK consumer law.

Liability cap. Subject to the carve-outs above, our total aggregate liability to you, in contract, tort (including negligence), under statute, or otherwise, arising out of or in connection with any one order, is capped at the amount you paid us for that order.

Excluded losses. Subject to the carve-outs above, we are not liable for indirect or consequential losses, lost profits, lost business, or loss of opportunity arising from the Service.

Your indemnity to us. You agree to indemnify GiftKoin and our officers, employees, and contractors against any third-party claim, loss, liability, or reasonable cost (including legal costs) that arises out of or in connection with: (a) your breach of these Terms; (b) your breach of any issuing platform's terms relating to a code we delivered to you; (c) your use of crypto or wallets that are subject to sanctions, fraud, money-laundering, or other illicit-source claims by the original owner or by a regulator; or (d) your fraudulent or unlawful use of the Service. This indemnity does not apply to claims caused by our own breach of these Terms or our own negligence, and it does not limit your statutory consumer rights.

Set-off. Where you owe us money under these Terms — for example, where we have agreed to refund or credit you and we have an outstanding amount owed by you (such as a chargeback we incurred, a claw-back from an issuing platform tied to a code we delivered to you, or our reasonable costs of investigation under section 11) — you authorise us to set off that amount against the refund or credit, and to pay only the net amount.

13. Force majeure

We are not in breach of these Terms, and we are not liable to you, for any delay or failure to perform that is caused by circumstances beyond our reasonable control. Without limit, that includes:

  • Crypto network events — congestion, fork, hard fork, network re-organisation, validator outage, RPC outage, oracle failure, or other failures of the blockchain network you chose to pay on.
  • Third-party platform actions — actions by the platform that issued a code (for example Apple, Sony, Steam, Google) including freezing, invalidating, refusing redemption, or suspending an account.
  • Cloud, infrastructure, and partner outages — outages of our hosting, blockchain analytics, identity verification, or payment-monitoring providers.
  • Government, legal, or sanctions actions — court orders, regulator orders, sanctions designations, new legal restrictions, lawful takedown requests, war, civil unrest, pandemic, act of God.

If a force-majeure event materially affects an order, we will tell you when we can and apply the refund rules in section 8 where they apply.

14. Communications and notices

The email address on your account is the binding channel for legal and contractual notices we send you — for example, T&C changes, identity verification requests, account closure, breach notices, and personal-data breach notifications. You agree to keep your account email current.

We may also message you through Telegram or WhatsApp for support and convenience. Those channels are not binding for legal notices and are not a substitute for your account email.

15. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top of the page reflects the most recent change.

For material changes — for example, a change in the refund rules, the liability cap, the AML triggers, the governing law, or the categories of acceptable use — we will email active users at least 14 days before the change takes effect, so you can review it.

Non-material changes — typo fixes, plain-language clarifications, broken-link repairs — take effect when posted.

Continuing to use GiftKoin after a change takes effect means you accept the updated Terms. If you do not accept them, you can close your account under section 3 or section 11, and we will handle in-flight orders and store credit under sections 8 and 11.

16. Governing law, jurisdiction, and complaints

Governing law. These Terms and any dispute arising from them or from your use of the Service are governed by the law of England and Wales.

Where claims are brought.

  • If you use GiftKoin as a consumer resident in the United Kingdom or the European Economic Area (for purposes outside your trade, business, or profession), you have the benefit of the mandatory consumer protections of the law of the country where you live, and you may bring a claim in the courts of that country. We may bring claims against you only in the courts of the country where you live.
  • All other users — including consumers resident outside the United Kingdom and the European Economic Area, and any user not acting as a consumer — agree that the courts of England and Wales have exclusive jurisdiction over any claim arising from these Terms or from your use of the Service.

Time limit on claims. You must bring any claim arising out of or in connection with these Terms or your use of the Service within 12 months of the event giving rise to the claim. After that period, your claim is time-barred. This shorter period does not apply where UK consumer law gives you a longer period that cannot be limited in this way.

Complaints first — pre-claim notice. You agree not to start any legal proceedings against us until you have first contacted us at [email protected] with full details of your claim, and we have either failed to respond substantively within 30 days, or our response has not resolved the issue. Proceedings begun in breach of this requirement may be dismissed or stayed. Most issues are resolved at this step.

Supervisory authority. UK consumers may also complain to the UK supervisory authority for matters within its remit; we can provide its current contact details on request.

17. Customer tiers and discretionary discounts

We may operate a customer tier system from time to time. Tiers are a discretionary loyalty feature, not a contractual entitlement. They do not affect your statutory consumer rights.

How tiers work. Every account starts at the entry tier (currently Bronze). We may at our discretion offer higher tiers (for example, Silver, Gold, or Diamond). Promotion between tiers is normally automatic, based on your purchase history; we may also take into account your account standing, identity verification status, and any other factor we consider relevant, and we are not obliged to maintain, offer, or grant any tier.

Benefits. Higher tiers may receive discounts on specific products, faster support response, or other benefits we choose to offer at any given time. Discounts and benefits are limited to the products and conditions we publish on the Site at the moment of your order.

Our discretion. We may at any time, at our sole discretion, and without prior notice to you:

  • Add, change, rename, suspend, or remove any tier or any benefit attached to any tier.
  • Add, change, reduce, or remove any discount, including the products to which a discount applies.
  • Move your account between tiers — including downgrading you, where in our reasonable view a downgrade is appropriate (for example, on a fall in qualifying activity, on identity-verification issues, or on suspected breach of these Terms).
  • Suspend or end the tier programme entirely.

The tier list, the benefits, and any discounts that apply at the moment of your order are the version live on the Site at that moment. Past discounts do not create a right to future discounts of the same size, on the same products, or at all.

Tier obtained by error or fraud. If we believe (acting reasonably and in our sole discretion) that you obtained or kept a tier promotion through error, fraud, manipulation of purchase activity, multiple-account abuse (see section 10), or any other breach of these Terms, we may revoke the tier, withdraw any associated benefit, and re-charge the difference between the discounted price you were given and the price the order would have had at your correct tier. We may set off that difference under section 12.

Personal and non-transferable. Tiers are tied to your account. They are not transferable, sellable, assignable, or combinable with another account.

Disputes about tiers. Where there is a dispute about your tier, the discount applied, or the eligibility of a benefit, we will explain our reasoning. If you remain dissatisfied, the complaints process in section 16 applies.
